Getting Ready To SELL


Sellers Declaration:


The SELLERS Declaration is made in terms of Section 67 of the PROPERTY PRACTITIONERS Act 22 OF 2019 that requires the PROPERTY CONSULTANT to complete a mandatory form prior to signing the Exclusive Marketing Authority.

The SELLER of the PROPERTY discloses the information relating to the condition of the PROPERTY in the full knowledge that, even though this is not to be construed as a warranty, prospective PURCHASERS of the PROPERTY may rely on such information when deciding whether, and on what terms, to purchase the PROPERTY. The SELLER hereby authorizes the appointed PROPERTY CONSULTANT marketing the PROPERTY for sale to provide a copy of this declaration, and to disclose any information contained in this declaration, to any person in connection with any actual or anticipated sale of the PROPERTY.

Very Important Notifications


  1. You need to notify the bank that holds your bond, of your intention to sell the property The waiting period to avoid penalties is 90 days.
  2. Within 14 days of bond grant, you will need to provide certificates of compliance for all electrical and gas installations, as well as the electric fence.
  3. Rates and Taxes with the City of Johannesburg needs to be paid 6 months in advance to obtain clearance figures.
  4. All personal tax needs to be up to date for the attorneys to register your property. Should personal tax not be up to date, delays can be experienced, and costs can be incurred.
  5. Everything that is mounted to a wall is a fixture. Should you wish to exclude a fixture please ensure that you exclude it in the offer to purchase. Please notify the agent when listing the property.

  1. Latest Audited Financial Statements from Body Corporate (If applicable)
  2. Copy of Rates and Taxes Account
  3. Copy of the Levy Account
  4. Copy of the Rules & Conduct Code of the complex (If applicable)
  5. Completed Sellers Information Schedule

FICA DOCUMENTS REQUIRED


  1. Copy ID of all Parties (certified copies required where original ID not available)
  2. Proof of Address (not older than 3 months)
  3. Copy Marriage Certificate (if applicable)
  4. Copy Anti-Nuptial Agreement (if applicable)
  5. Document proving Authority to act on behalf of Owner (i.e., Power of Attorney, Letter of Authorisation, or similar document – if applicable)

TIPS for Sellers when Preparing your Home


1. Check Your House's Street Appeal
2. Remove any clutter in your house and garden.
3. Repair all wall cracks or uneven driveway or walkway surfaces.
4. Cut the Gras, give your Garden a good clean and a facelift example Plant some inexpensive plants.
5. Are your windows and walls clean?
6. Does your front door need paint?
7. Ensure your gutters are clear of debris and in good repair.
8. Are your backyard and walkways clean?
9. If you have a swimming pool, is it sparkling blue?
10. Do all the in and outside lights work? Replace any burned out bulbs, and clean fixtures of dirt and cobwebs.
11. Is there a shed? Does it look presentable?
12. Make sure all your electrical appliances are in a working order ( Gate garage motors)
13. Scrub all sinks and toilets.
14. Wash and/or vacuum all floors.
15. Clean the gutters.
16. Make minor repairs (i.e. fix doorbell).
17. Paint where necessary.
18. Replace loose or damaged roof tiles and fix any roof leaks
19. Clean out the garage
